Bekas menteri undang-undang, Azalina Othman Said membidas ahli Parlimen Selayang, William Leong yang mempertikaikan apakah Perdana Menteri Muhyiddin Yassin yang meluluskan supaya dakwaaan pertuduhan pengubahan wang haram berkaitan dana 1MDB terhadap Riza Aziz digugurkan.

Azalina berkata soalan seperti itu juga boleh ditujukan kepada bekas perdana menteri Dr Mahathir Mohamad apabila bekas menteri kewangan Lum Guan Eng dibebaskan daripada pertuduhan rasuah terhadapnya.
“YB Leong, saya khuatir kenyataan/soalan yang ditujukan kepada YAB PM itu bak kata “menjolok sarang tebuan”.

“Izinkan saya merujuk kepada keputusan mantan pendakwa raya untuk 'nolle prosequi' terhadap YB Bagan pada 2 Ogos 2018.

“Adakah PM7 terlibat dalam keputusan itu? Pasti tidak kan? Atau mungkin anggapan saya salah?” ciapnya di Twitter.

“Saya yakin saya tidak perlu mengingatkan YB mengenai prinsip pemisahan kuasa antara eksekutif, kehakiman dan badan perundangan, kan?,” katanya.

Pemimpin Umno itu berkata demikian apabila mengulas artikel Leong yang diterbitkan oleh Focus Malaysia pada Ahad lalu.

Ahli Parlimen PKR itu bertanya adakah Muhyiddin meluluskan perjanjian tawar-menawar dengan Riza itu.

Bagaimanapun, Muhyiddin melalui kenyataan Pejabat Perdana Menteri sebelum ini menyatakan bahawa beliau tidak terlibat dalam keputusan mahkamah yang melepaskan tanpa membebaskan (DNAA) anak tiri bekas perdana menteri Najib Razak itu.

Pada 14 Mei lalu, mahkamah berkata persetujuan telah dicapai antara pihak Riza dan pendakwaan dalam lima pertuduhan pengubahan wang haram.

Dalam persetujuan itu, Riza dilepas tanpa dibebaskan atas pertuduhan itu dengan syarat memulangkan semula aset dari luar negara dengan nilai anggaran AS$107.3 juta (RM465.3 juta).

Jika Riza gagal untuk mematuhi perjanjian tersebut, maka pendakwaan berhak untuk mengenakan semula pertuduhan tersebut dan mendakwanya di mahkamah.

Pada Sept 2018, Mahkamah Tinggi Pulau Pinang membebaskan bekas ketua menteri Lim Guan Eng daripada dua tuduhan rasuah selepas peguam negara menerima hujah balasan daripada peguam.

Lim yang ketika itu merupakan menteri kewangan didakwa bersama ahli perniagaan Phang Li Koon di Mahkamah Tinggi Pulau Pinang George Town, menjelang pilihan raya umum (PRU) ke-14.

Kedua-dua mereka menghadapi tuduhan berkenaan ekoran urusan jual beli sebuah banglo di Jalan Pinhorn, George Town, di katakan di bawah harga pasaran semasa.

PLEA – BARGAIN

1. Malaysia had never accepted nor practiced the concept of plea- bargain in which a criminal suspect would offer to help the Government in return for some concession to his advantage.

2. Plea-bargain is practiced in the United States of America. Even then it is about information which will give bigger gains to the Government. It is not about returning stolen money. Most certainly it is not about returning less than half the money stolen.

3. The concession given to Riza Aziz is unique. He will source it from the money seized by the Department of Justice (DOJ) of the United States of America.

4. Now this money would, by agreement with the previous Attorney General (AG), be returned to Malaysia upon proof that it belongs to Malaysia.

5. So what Riza Aziz is willing to return is less than half of the money which will be seized by the US Department of Justice (DOJ), which the department is going to return to Malaysia.

6. The bigger chunk of the money stolen by Riza would be retained by him. In other words, he is going to retain money stolen by him and be acquitted as well.

7. All the people involved in making this decision are protesting that they did not make the decision. Obviously, they know that the decision is wrong.

8. The public is disgusted and angry. Is this the kind of justice practiced in Malaysia?

9. There is a new Government in Malaysia. This Government is in place because it has the support of people presently being tried for stealing money, for money laundering and for corruption.

10. We, in fact, have a Government backed by people with criminal background. We cannot feel sure that justice will be upheld in this country, because of the power and influence of these criminals.

11. Already we are seeing Parliament being silenced. Democracy is dead.

12. But it is okay. Your chosen representative support the muzzling of the representative of the people.

13. The whole world is laughing at Malaysia. The world labelled Malaysia as a kleptocracy (government of thieves) when Najib was the Prime Minister.

14. There was recovery of the respect of the world when the people chose the coalition of opposition parties to form the Government.

15. But now the kleptocrats are back because the president of the party which pledged to overthrow Najib has brought him back.

16. And now that the kleptocrat is back, a practice unheard of in Malaysia has been used and is likely to offer to withdraw charges against other thieves if they would return a fraction of the money they had stolen.

17. Najib campaigns with the slogan “Why be ashamed of your boss being a thief”. And those Malaysians who now brought him back are truly not ashamed of bringing back a thief to be in the Government.

Former PM Dr Mahathir Mohamad says plea bargaining is practised in the US, but it is about information which will give bigger gains to the government and not about returning stolen money.

PETALING JAYA: Former prime minister Dr Mahathir Mohamad said the money-laundering charges dropped against Riza Aziz after a plea bargain had set a dangerous precedent for future cases.

Riza, the stepson of former prime minister Najib Razak, had been charged with five counts of money laundering amounting to US$248 million (RM1.08 billion) tied to 1MDB. He was granted a discharge not amounting to an acquittal (DNNA) by the Kuala Lumpur Sessions Court last week.

Putrajaya said it expected to recover overseas assets worth an estimated US$107.3 million from the Hollywood producer, but Mahathir was worried that the plea bargain practice — which he said was previously unheard of in Malaysia — would likely be offered again to withdraw charges “against other thieves if they returned a fraction of the money they had stolen”.

“Malaysia had never accepted or practised the concept of plea bargaining, in which a criminal suspect would offer to help the government in return for some concession to his advantage,” said Mahathir in a blog post today.


“Plea-bargaining is practised in the United States. Even then, it is about information which will give bigger gains to the government. It is not about returning stolen money. Most certainly, it is not about returning less than half the money stolen.”

Under a settlement announced by the court on May 14, Riza will surrender his rights to three properties seized by the US Department of Justice (DoJ), forfeit the money seized from him by the government, and pay a RM500,000 compound fine under the Anti-Money Laundering and Anti-Terrorism Financing Act.

Riza had claimed trial in July 2019 to the money laundering charges allegedly involving funds received from Good Star Ltd and Aabar Investments PJS Ltd, two companies said to be linked to fugitive businessman Low Taek Jho, or Jho Low.

Mahathir said the money Riza was to return would be sourced from the money seized by DoJ, which the department had already agreed to return to the previous administration upon proof that it belongs to Malaysia.

Stressing Riza would return less than half of the money seized by the DoJ, Mahathir said the acquittal had left the public “disgusted and angry”.

“We, in fact, have a government backed by people with criminal backgrounds.

“We cannot feel sure that justice will be upheld in this country because of the power and influence of these criminals.
“The whole world is laughing at Malaysia.”

antara lain plea bargaining ni menurut Aidil Khalid adalah amalan tawar menawar yang dibuat di antara pihak yang dituduh melakukan jenayah, dengan pihak pendakwaan. Biasanya pihak pembelaan akan menulis representasi kepada pendakwaan, bagi menawarkan sesuatu (contohnya menawar diri untuk menjadi saksi pendakwaan), jika pertuduhan dikurangkan terhadapnya, atau ditarik balik sepenuhnya.

PLEA-BARGAINING: TUN DR MAHATHIR SUDAH KARUT TERLAMPAU

Di dalam tulisan terbaru beliau hari ini, Tun Dr Mahathir menyebut “Malaysia had never accepted nor practiced the concept of plea-bargaining” (“Malaysia tidak pernah menerima atau mengamalkan konsep konsep tawaran pengakuan bersalah”).

Tidak tahukah Tun Dr Mahathir bahawa konsep tawaran pengakuan bersalah telah diterima dan diamalkan oleh Malaysia melalui the Criminal Procedure Code (“CPC”) (Amendment) Act 2010?

Tidak tahukah Tun Dr Mahathir bahawa tawaran pengakuan bersalah ini telah diperuntukkan di dalam Seksyen 172C CPC ini yang sub-seksyen 1 nya berbunyi: “An accused charged with an offence and claims to be tried may make an application for plea bargaining in the Court in which the offence is to be tried” (“Seseorang tertuduh yang didakwa atas satu kesalahan dan meminta dibicarakan boleh membuat satu permohonan untuk tawaran plea bargaining di dalam Mahkamah di mana kesalahan itu akan dibicarakan”)?

Tidak tahukah Tun Dr Mahathir bahawa, berdasarkan laporan NST hari ini:
(1) Sebanyak 571 DNAA telah direkodkan pada tahun 2015?
(2) Sebanyak 1,020 DNAA telah direkodkan pada tahun 2016?
(3) Sebanyak 643 DNAA telah direkodkan pada tahun 2017?
(4) Sebanyak 3,215 DNAA telah direkodkan pada tahun 2018?
(5) Sebanyak 605 DNAA telah direkodkan dari Januari ke April 2019?

Sudah karut terlampau nampaknya Tun Dr Mahathir ini.

Sebab itulah saya kata elok sahaja beliau segera bersara.
