Equanimity dibida separuh harga

SELENGGARA EQUANIMITY: KERAJAAN BELANJA RM2 JUTA SETELAH 20 HARI

Kapal mewah Equanimity telah tiba di perairan negara pada 7 Ogos 2018. Kerajaan membuat pengumuman akan menanggung kos penyelenggaraan dan kerosakan ke atas kapak mewah tersebut.

Kerajaan juga perlu berbelanja RM3 juta sebulan bagi kerja-kerja penyelenggaraan kapal mewah itu.

Sebuah Syarikat penyelenggaraan telah dilantik kerajaan untuk menyelenggara dan memastikan keselamatan kapal dan semua 18 kru sepanjang tempoh penyitaan mahkamah.

Menurut sumber sehingga hari ini iaitu pada 27 Ogos 2018, kerajaan telah membelanjakan RM2 Juta dari duit rakyat untuk menyelenggara kapal tersebut. Jumlah itu akan dibayar kepada syarikat penyelenggaraan itu.

Setakat hari ini pihak kerajaan masih lagi belum mendedahkan syarikat manakah yang dilantik untuk menyelenggara Equanimity.

Sebelum ini, kos selenggara sebanyak RM3 juta telah menjadi tandatanya kepada orang ramai termasuk pakar-pakar pelayaran.

Seorang pakar kapal mewah iaitu Pengarah operasi Mega Yacht Club of Vanuatu Ltd, Nicholas de Souza, berkata jumlah RM3 Juta itu adalah lebih daripada mencukupi untuk pengambilan 25 anak kapal dengan gaji yang tinggi dan kapten kapal kanan secara tetap.

"RM3 juta sudah tentunya cukup memberi krew-krew kapal menginap di hotel 6 bintang dan cukup untuk berpesta setiap hari atau mengadakan pesta yang amat besar setiap minggu di atas kapal tersebut," katanya.

Beliau menyatakan demikian ketika diminta mengulas satu laporan berita bahawa ia menelan kos kira-kira RM3 juta sebulan untuk menyelenggara sebuah kapal layar yang amat besar.

Equanimity, telah dikaitkan dengan kontroversi dan didakwa oleh Kerajaan yang ia dibeli dengan menggunakan dana yang dicuri daripada 1MDB. Bekas Perdana Menteri iaitu Ds Najib Razak juga turut dituduh terlibat dalam skandal ini.

Kapal sepanjang 91.5 meter itu tiba di Pelabuhan Klang pada 7 Ogos 2018 selepas kerajaan Indonesia, yang merampasnya awal tahun ini, bersetuju untuk menyerahkan penjagaannya kepada pihak berkuasa Malaysia setelah mereka berasakan tidak perlu untuk menanggung kos selenggara Kapal mewah tersebut.

Kapal mewah tersebut telah disita dan diarahkan untuk parkir di pelabuhan mewah yang juga tempat berlabuh untuk kapal Star Cruise iaitu di Bousted Cruise Center, Port Klang.

Menurut de Souza lagi, walaupun kos boleh berbeza-beza dari satu tempat ke tempat lain, perbelanjaan penyelenggaraan asas untuk kapal layar mewah di Langkawai hanya mencecah kira-kira RM75,000 sebulan melibatkan krew minimum dan bayaran tempat parkir.

Kerajaan dibenarkan lantik broker jual Equanimity

KUALA LUMPUR: Kerajaan Malaysia hari ini dibenarkan Mahkamah Admiralti untuk melantik broker asing bagi menjalankan urusan penjualan kapal layar mewah milik ahli perniagaan Low Taek Jho atau Jho Low.


Peguam Sitpah Selvaratnam mewakili Kerajaan Malaysia ketika ditemui selepas pendengaran permohonan bagi perintah jualan, berkata bermula hari ini broker itu dan jurunilai antarabangsa akan melakukan kerja dokumentasi seperti urusan iklan dan memorandum maklumat.

Sitpah berkata, ia adalah supaya pembeli berpotensi mengetahui apa yang boleh dilihat pada spesifikasi dan keadaan kapal.

“Kami sudah mendapat pelantikan yang diluluskan hari ini... semuanya akan bermula dari sekarang dan beberapa minggu akan datang. Kami menjangkakan kapal akan dijual secara rasmi dan dibuka untuk tender yang akan dimasukkan ke dalam pembelian.

“Mungkin dari November minggu kedua dan ke atas... oleh itu pada akhir Disember atau awal November kami boleh menjual kapal itu.

“Sudah tentu kita tahu ia adalah pasaran ceruk dengan bilangan pembeli berpotensi di luar sana kecil tetapi kami masih berharap ada pembelian baik yang dapat diterima.

“Berhubung dengan harga pula, kami tidak tahu lagi dan ia akan menjadi rahsia... penilai akan menyediakan laporan mereka dan ia adalah sulit,” katanya.

Ditanya lanjut mengenai broker yang dilantik, Sitpah berkata ia adalah broker asing yang terkenal di peringkat antarabangsa dalam industri kapal layar.

Sitpah berkata, hanya seorang broker dilantik manakala broker lain boleh mengemukakan permohonan dan bekerjasama bagi mendapatkan maklumat,

Bagaimanapun katanya, penilai yang dilantik pula hanya satu syarikat daripada United Kingdom.

“Kami membuka tender dan meminta sesiapa saja untuk memasukkan tawaran dan cadangan mereka berhubung penilaian dan pemasaran kapal.

“Daripada keseluruhan pilihan kami mahkamah mengesahkan pelantikan penilai itu.

Ditanya sama ada Jho Low atau syarikatnya memasuki kehadiran dalam permohonan itu di mahkamah hari ini, Sitpah berkata: “Tidak.”

“Tiada siapa yang secara rasmi datang kepada kami,” katanya.

Pada 24 Ogos lalu. Mahkamah Tinggi (Bahagian Admiralti) membenarkan permohonan Kerajaan Malaysia dan tiga lagi untuk menjual kapal mewah Equanimity yang didakwa milik Jho Low.

Pesuruhjaya Kehakiman, Datuk Khadijah Idris, membenarkan permohonan bagi mendapatkan perintah penilaian dan penjualan dikemukakan kerajaan, 1Malaysia Development Berhad (1MDB) dan dua subsidiarinya Global Investment Limited serta Energy Holdings Limited mengikut Perintah 29 Aturan 4 Kaedah Mahkamah 2012.

Melalui permohonan difailkan pada 6 Ogos lalu, mereka menamakan pemilik kapal dan syarikat Equanimity (Cayman) Ltd beralamat di United Kingdom sebagai defendan pertama dan kedua.

Mahkamah membenarkan permohonan itu dengan alasan bagi mengelakkan kos penyelenggaraan tinggi, selain ia boleh menyebabkan kerosakan sehingga aset itu susut nilai dan alasan keselamatan.

1MDB, govt apply for judgement in default over sale of Equanimity​

The superyacht, Equanimity, was brought to Port Klang on Aug 7 after the Indonesian authorities handed it over to Malaysia.

KUALA LUMPUR: 1MDB, the government and two others have sought a judgment in default against the registered owner of the Equanimity over the sale of the superyacht.

Lawyer Sitpah Selvaratnam, who is leading the legal team for the four plaintiffs, told reporters that the application was heard this morning before High Court judicial commissioner Khajidah Idris.

“The hearing will continue tomorrow at 3pm,” she said.

Besides 1MDB and the government, the other two plaintiffs are MDB Energy Holdings Limited and 1MDB Global Investment Limited, which are 1MDB subsidiaries.

On Oct 5, the same court had granted an application by the four plaintiffs to appoint a central broker and an international appraiser to handle the sale of the Equanimity, which purportedly belongs to fugitive businessman Low Taek Jho, better known as Jho Low.

It followed a decision on Aug 24 by the same court in granting an application by the four plaintiffs to sell the Equanimity.

In the application filed on Aug 23, the four plaintiffs named the owner of the ship, Equanimity, of Cayman Islands, as the defendant in the suit filed through the law firm of Jeremy Joseph & Partners.

In the notice of application, the four plaintiffs asked for the sale of the ship, bunkers, fuel, lubricants and other consumables on board to be conducted via public tender or private treaty by the Admiralty Court’s sheriff.

The plaintiffs wanted the sheriff to receive bids or offers for the vessel and the bunkers and for the purchase price to be paid to the sheriff in US dollars or euros or ringgit.

They said the proceeds of the sale of the vessel should be paid into court and placed in a bank account in Malaysia as approved by the accountant-general.

The superyacht was brought to Port Klang on Aug 7 after the Indonesian authorities handed it over to Malaysia.

It was seized off Bali in February at the request of the US authorities as part of the corruption investigation launched by the US Department of Justice (DoJ) into 1MDB.

KUALA LUMPUR: The High Court has ruled that the government and three others are the rightful owners of superyacht Equanimity which will be up for sale next month.

Lawyer Sitpah Selvaratnam said the court here made the order in allowing judgment in default against the registered owner of the vessel, which has been berthed in Port Klang since August.

“In effect, the court held that the ship belonged to the Malaysian government because 1MDB money was used to purchase it,” she told reporters after obtaining the judgment in the chambers of judicial commissioner Khajidah Idris.

Sitpah said the ship belonged to Malaysia since two of the plaintiffs, 1MDB Energy Holdings Limited and 1MDB Global Investment Limited, were found to be the beneficial owners.

She added that the registered owner of the Equanimity, of Cayman Islands, had not turned up to contest the suit and deny the claim by the government, 1MDB and the two subsidiaries.

Sitpah said in delivering the judgment, the court went through strict judicial process and was finally satisfied that the RM1 billion (US$250 million) used to buy the yacht belonged to Malaysia and 1MDB, a company fully under the control of the finance ministry.

On Oct 5, the court granted an application by the four plaintiffs to appoint a central broker and an international appraiser to handle the sale of the Equanimity, which has been linked to fugitive businessman Low Taek Jho, better known as Jho Low.

This followed a decision on Aug 24 by the same court granting an application by the four plaintiffs to sell the Equanimity.

“The broker is now conducting the marketing and publicity to get bidders,” Sitpah said, adding that the tenders for sale would be open by the end of the month.

Sitpah said she hoped the vessel, the 54th largest yacht in the world, could be sold to the highest bidder by the end of the year.

She said the appraiser’s value of the ship would remain confidential as the government wanted more bidders to come in.

“Bids are not open yet but there are people showing interest,” she added.

In the application filed on Aug 23, the plaintiffs named the owner of the ship as the defendant in the suit filed through the law firm of Jeremy Joseph & Partners.

Equanimity sah milik kumpulan 1MDB, kata mahkamah​

Mahkamah Tinggi (Admiraliti) Kuala Lumpur memutuskan hari ini bahawa anak-anak syarikat 1MDB - 1MDB Energy Holdings Ltd dan 1MDB Global Investment Ltd - adalah pemilik sah kapal layar Equanimity.

Penghakiman itu dibuat oleh Pesuruhjaya Kehakiman, Datuk Khadijah Idris di dalam kamarnya hari ini setelah tidak ada yang datang untuk mencabar tuntutan yang dibuat bersama oleh kerajaan Malaysia dan 1MDB pada 6 Ogos.

Peguam Sitpah Selvaratnam, yang mengetuai pasukan perundangan yang dilantik oleh kerajaan untuk mengambil pemilikan kapal itu, memberitahu pemberita mengenai keputusan itu selepas menghadiri prosiding hari ini.

Sementara itu, peguam Ong Chee Kuan menambah bahawa kerana ini adalah prosiding mahkamah admiralti, mahkamah bukan sahaja mengambil kira ketiadaan apa-apa cabaran kepada tuntutan kerajaan dan 1MDB, tetapi juga merit hujah-hujah mereka.

Sebelum ini, mahkamah telah membenarkan permohonan kerajaan dan 1MDB untuk jualan segera kapal layar itu, yang sedang dilakukan oleh broker Burgess yang berpangkalan di London dan masih berterusan.

Keputusan hari ini bermakna 1MDB akan dapat mengumpul hasil penjualan - tolak perbelanjaan - apabila penjualan selesai.

Menurut Jabatan Kehakiman Amerika Syarikat (DOJ) tahun lalu, Equanimity dibeli oleh ahli perniagaan yang sedang diburu, Low Taek Jho menggunakan AS$250 juta dari dana 1MDB, dan dia memiliki kapal itu melalui Equanimity (Cayman) Ltd yang dia kuasai.

Pihak berkuasa Malaysia mengambil hak penjagaan kapal seluas 91.5 meter pada 6 Ogos, selepas ia dirampas oleh pihak berkuasa Indonesia. Ia tiba di Pusat Pelayaran Boustead di Pelabuhan Klang dan berada di situ.

Kerajaan dan 1MDB mendakwa di mahkamah bahawa 1MDB sepatutnya menjadi pemilik sah Equanimity sejak dibeli dengan menggunakan dana 1MDB, dengan menyebut tuduhan dalam saman sivil DOJ yang juga bertujuan merampas kapal itu.

Equanimity Ltd mendakwa bahawa pemilikan pembeli masa depan kapal itu akan dipertikaikan kerana perkara itu masih dipertikaikan di mahkamah AS, tetapi peguam yang dilantik oleh kerajaan Jeremy M Joseph menafikan ini, dengan mengatakan bahawa jualan kehakiman akan menyediakan pembeli dengan hakmilik ke atas kapal itu.


Burgess juga menunjukkan bahawa jualan kehakiman bebas daripada bebanan kepada bakal pembeli.

"Kami dinasihatkan bahawa menurut undang-undang Admiralti, jualan kehakiman akan memberikan pembeli dengan hakmilik yang diiktiraf di peringkat antarabangsa yang bebas dari gadai janji dan semua bebanan," katanya di laman webnya.

KUALA LUMPUR: The High Court (Admiralty) has ruled that the government and three others are the rightful owners of the luxury yacht Equanimity.

This, the court ruled, was because funds from 1Malaysia Development Bhd (1MBD) - a company fully controlled by the Finance Ministry - was used to purchase it.

Counsel Sitpah Selvaratnam, representing 1MDB and the government, said the court made the order in allowing judgment in default against the vessel’s registered owner.

A judgment in default is a binding judgment in favour of either party based on a failure to take action by one party, such as failing to respond to summons or failing to appear before the court of law.

“The court held that the ship belonged to the government because 1MDB money was used to purchase it,” she told reporters after obtaining the judgment before judicial commissioner Datuk Khajidah Idris.

“The vessel’s registered owner - Equanimity of Cayman Islands - did not turn up to contest the suit and deny the claim by the government, 1MDB and its two subsidiaries, 1MDB Energy Holdings Limited and 1MDB Global Investment Limited,” she said.

The RM1 billion vessel, said to be the 57th largest in the world, is currently anchored in Port Klang. It is expected to be put up for sale next month.

Sitpah said she hoped the vessel could be sold by the end of the year. The vessel’s value, she said, would be kept confidential as the government is keen on having more bidders enter the picture.

On Oct 5, the court granted an application by the government to appoint a central foreign broker to handle the sale of the vessel. An international appraiser will proceed with the documentation process such as advertisement and information memorandum.

It was reported on Aug 23 that the government, 1MDB and its two subsidiaries, 1MDB Energy Holdings Limited and 1MDB Global Investment Limited, had filed a court order seeking to expedite the sale of the vessel.

The plaintiffs named Equanimity of Cayman Islands as the defendant in the suit filed via the law firm Jeremy Joseph & Partners.

In the notice of application, the four plaintiffs are asking for the sale of the ship, bunkers, fuel, lubricants and other consumables on board to be conducted via public tender or private treaty by the Admiralty Court sheriff.

The firms want the sheriff to receive bids or offers for the vessel and the bunkers and for the purchase price to be paid to the sheriff in US dollars, Euros, or in ringgit.

The firms said the proceeds from the sale of the vessel should be paid to the court and placed in a bank account in Malaysia as approved by the Accountant-General.

A writ of summons was issued on Aug 6 to the “owner of the vessel“, as well as to Wilson Yacht Management Ltd, the company that operates Equanimity.

The superyacht was brought to Malaysia on Aug 7 after the Indonesian authorities handed over it to Malaysia.

It was seized off Bali in February at the request of the US authorities as part of the corruption investigation launched by the US Department of Justice (DoJ) into 1MDB.
