pulangkan balik kereta

Kalo boleh jangan pulangkan bulat2....bincang dulu dengan bank kalo tertunggak 2@3 bulan....sambil tu cari member/sanak saudara dan rakan taulan yang nak beli keter kita....kalau tak pun...refinance balik keter tu....memang interest rated refinance agak tinggi..tapi at least bayar bulan kurang sikit...kalao sekarang loan RM700++...dapat RM500 lepas refinance dengan ikat 7 tahun pun kira ok...maybe 2 tahun pertama selepas itu kita sesak skit...mana tahu tahun ke-3 dan seterus nya boleh rolling duit.....yang paling baik kalo boleh jual dengan org..jual je
 
harap boleh membantu...

Prosedur:

1. gi kat bank berkenaan untuk buat urusan pulangkan semula kenderaan
2. dia akan bagi satu alamat tpt untuk kita pulangkan (anak syarikat bank)
3. bila dah sampai ke tpt tu, pegawai dia akan jumpa kita. dah kita tunjukkan keta tu
4. dia akan tengok condition keta tu sama macam buat car inspection oleh syarikat repair keta (sebab aku tengok ada kertas diagram keta). kalau ada kemik accident, dia akan bulatkan kawasan tu dia ats kertas.
5. dia juga akan check enjin... sama ada ok atau tak... dia akan tulis remarks kat situ.
6. Pegawai tu juga akan suruh kita kosongkan keta tu ... amik segala bantal ke, kotak tisu ke, apa aje lah...termasuklah dalam drawer dashboard... KOSONGKAN...pastu kena sain surat serah semula
7. Dia akan bagi tau surat akan dihantar dalam masa 2 minggu (rasanya)kepada penama memaklumkan keta tu keta tu akan diLELONG dia kawasan lelongan awam. Kalau nak gi tengok masa lelongan awam pun boleh.
8 then ...jika ada pembeli dia akan inform melalui surat.
9. Dalam surat tersebut menyatakan, keta tu telah dijual dan ada berbaki sekian-sekian RM. contohnya RM18k, keta tu pulak dilelong dengan harga 8k, baki hutang iaitu rm10k akan dibayar oleh tuan lama kepada pihak bank dalam tempoh 14hari (boleh nego untuk bayar ansuran).
10.Jika bayar complete, lepaslah anda dari tanggungan kereta tu...SELESAI

time lelong kereta..mmg comfirm rendah sangat price nya.. yg empunya badan siap sedia la membayar baki hutang tu.
 
kalo bli cash nak pulang amendenye? hehe. betul2 kalau cash xkan bank punye lagi. dia claim kita bakar la bank tu. haha
 
kalau keta tu hilang/dihilangkan/menghilang cemana pulak?
kena bayar bulan gak ka?

Ada lagi satu cara, ko tak yah pulangkan kete kat bank, cari sesapa yang sambung bayar kereta itu dengan monthly yg sama, make sure orang itu background dia TAK BLACKLIST dan keadaan kewangan dia cantik termasuk apa-apa statement i.e kad kredit, ansuran umah etc dan gaji/income cantik. Prosedur dia cam ni :

1 ) Ko g bank , pemilik dan si penyambung bayar (aku guna singkatan 'buyer') hadir bersama
2 ) Katakan kepada bank, ko nak mintak org ketiga sambung bayar untuk ko kerana ko tak mampu lagi utk bayar kete tu
3) Bagi semua dokumen buyer kepada bank utk penilaian kredit
4) Bank akan bagi approval TERTAKLUK kepada penilaian kredit buyer
5) Bank akan sediaakan perjanjian baru antara buyer dan bank yang mana SEMUA termn and condition sebelum ini TIDAK BERUBAH TERMASUKLAH INTEREST, JUMLAH BAYARAN BULANAN. BANK HANYA BUAT AGGREEMENT BARU SAHAJA ATAS NAMA BUYER DAN PROSES TUKAR NAMA KAT GERAN.

PENTING : BANK TIDAK BOLEH KENAKAN APA-APA CAJ TAMBAHAN KE ATAS AGREEMENT BARU TERSEBUT KECUALI UTK KOS TUKAR NAMA (JPJ) DAN PUSPAKOM SERTA INSURANS BODY

6) Kereta itu akan jadi hak milik baru buyer dan ko tak akan terlepas dr tanggungan hire purchace kereta itu.


Jika bank tak bagi approval sedangkan buyer mempunyai rekod bersih dr segi kewangan dan mampu, ko boleh lawan balik bank dan perkara ini boleh di failkan di mahkamah (segala kos peguam dan lain2 akan terlibat).


Nota :

-Perkara ini ada dinyatakan dalam Hire Purchase Act 1967,
Section 12 (Assignments of rights under hire-purchase agreement)



Section 12. Assignments of rights under hire-purchase agreement.
(1) The right, title and interest of a hirer under a hire-purchase agreement may be assigned with the consent
of the owner, or if his consent is unreasonably withheld, without his consent.
(2) Except as otherwise provided in this section, no payment or other consideration shall be required by an
owner for his consent to such an assignment as is mentioned in subsection (1) and where an owner requires
any such payment or other consideration for his consent, that consent shall be deemed to be unreasonably
withheld.
(3) Where, at the request of a hirer under a hire-purchase agreement, the owner fails or refuses to give his
consent to an assignment by the hirer or his right, title and interest under the agreement, the hirer may apply
to the High Court for an order declaring that the consent of the owner to that assignment has unreasonably
been withheld, and where such an order is made that consent shall be deemed to be unreasonably withheld.

(4) As a condition of granting consent to an assignment of the right, title and interest of the hirer under a hirepurchase
agreement, the owner may stipulate that all defaults under the agreement shall be made good and
may require the hirer and assignee -
(a) to execute and deliver to the owner an assignment in a form approved by the owner whereby
without prejudicing or affecting the continuing personal liability of the hirer in those respects
the assignee agrees with the owner to be personally liable to pay the instalments remaining
unpaid and to perform and observe all other stipulations and conditions of the hire-purchase
agreement during the residue of the term thereof and whereby the assignee indemnifies the
hirer in respect of those liabilities; and
(b) to pay the reasonable costs (if any) incurred by the owner in stamping or registering the
assignment agreement or counterparts

(5) The refusal on the part of the owner to give consent to an assignment as is mentioned in subsection (1) on
the ground that he requires other or additional guarantors to guarantee the assignee's obligation shall be
deemed unreasonable -
(a) where the same guarantors who have guaranteed the hirer's obligation under the hire-purchase
agreement have agreed to guarantee the assignee's obligation under that agreement; or
(b) where the assignee has furnished the same number of guarantors as was furnished by the hirer
to guarantee his obligation under the hire-purchase agreement as guarantors for his obligation
under the agreement.

-Kalau ko tanya bank, bank biasanya akan kata tak boleh pasal kadang2 oficer dia pun tak berapa arif dengan akta ini ATAUPUN dia malas nak buat baru pasal kalau boleh dia nakl buyer buat loan baru, dapatlah kenakan interest baru dan untung lah sikit..
