Question
There are several methods of earning income online now, and many people are profiting. I am also thinking of getting involved, but I don't know whether these commercial transactions are lawful in Islam. Some of the ways of earning are as follows: 1) Affiliate programs : In these programs, some other online merchant’s products are sold via your website, and that merchant will give you a commission for each sale. 2) There are some programs whereby, if you send someone to the merchant’s link, he will be tracked by cookies, and if that person purchases anything, you will be given a commission on those purchases. 2)Internet Referrals: In this arrangement, if you refer someone to a site, you will be paid for the referral itself. This can be a “pay per click” scheme. In this arrangement, an ad is placed on your website, and if somebody clicks on that ad, you will be paid a fixed rate for that.

All of these means of doing business are lawful as long as the goods and services involved are lawful in and of themselves and as long as no fraud or deception is engaged in. The first case is a straightforward case of selling a product for someone else and taking a commission. This is a normal accepted business practice in Islamic Law. The second case is taking a commission on goods bought by someone who is brought to the seller by a referring agent. This is also a quite straightforward practice. The third case is comparable to being paid for the service of bringing someone to a certain venue. Here, you are being paid for the service rendered and not a commission on the goods and services sold. It is like someone working in a town as an agent for a hotel or a shop who takes people by the hand and leads them to that venue. For each person the agent leads to the venue, he gets paid a fixed amount for the service that he has rendered, regardless of whether the person brought to the place purchases any goods or services. Again, it is a quite straightforward business relationship. And Allah knows best.

Question
I joined an affiliate program, which is actually an online shopping site. If I refer a new member to the site, they will give me a commission. The new registrants are not obliged to shop actually. What matters is that they register. I’ve informed my family members to join the site in order to get me the commissions. They will physically sit in front of a computer with an Internet connection. I’ll tell them how to join and give them the referral link to go through. They will join the site on their own. It’s not compulsory for them to make any purchase to be a member of the site. Only registration is required. All I’ll do is inform and instruct them on what to do. I’ll not do anything on my own. Please note that the website doesn’t mention that an affiliate’s family member cannot join through his or her referral. Will this be lawful in Islam?

As long as you fulfill all of the conditions set by the company for being entitled to receive the commission, then if you do so as you describe above by having the family member present and registering on the site on his or her own, then – Allah willing – there should be nothing wrong with it. The reason we say this is that by having your family members visit the site on their own and register, you have fulfilled the service of actually referring them to the site, which is indeed what the commission is being paid to you for. You must be careful to comply with all of the guidelines set by the company to be eligible for the commission. You must not yourself, or have anyone else, deliberately misrepresent information so you can receive a commission. That would be fraud. Fraud is a sin. Allah says: “Woe to those that deal in fraud,- those who, when they have to receive by measure from men, exact full measure, but when they have to give by measure or weight to men, give less than due. Do they not think that they will be called to account on a Mighty Day, a Day when (all) humanity will stand before the Lord of the Worlds?” [Sûrah al-Mutagffifîn: 1-6] Any money earned through fraudulent means will be unlawful wealth. And Allah knows best.

How can an affiliate program become HARAM?
Question
I joined an online affiliate program which rewards its members for referrals. For every person who registers and mentions me as the person who referred them to the site, I will receive a commission. Now, since I belong to a large family, I wish to use their names to register with, mentioning my name as the one who referred them. I will ask for their formal permission, making sure that they have no objection to me registering them as members of various websites. They have faith in me and permit me to register on their behalf so I can receive the benefits. They have also permitted me to avail myself of any services on their behalf. I’d like to know whether in this situation with all of my family members’ permission, I can register them through my referral link and get the commissions. I'll obviously use real identifications everywhere I join in. Is this lawful in Islam? Please know that if I had wanted to, I could have joined up thousands of false members for the commission. But I know that will be totally unlawful. And I don’t want to earn anything through sinful means. Whatever I earn, I'll definitely earn it lawfully providing real information.

Registering these people’s names when they neither visited the websites nor have any desire on their own to join those sites is a gross misrepresentation of what is going on. The commission is being paid to you for your referring the websites to those people. What is effectively being said upon registration is that the person is registering for his own purposes and was merely referred to the service by you. Your using their names to register and making it seem as if you referred those people to the site is a lie, a fraud, and a deception. If they give you permission to do so, they are merely giving you permission to use their names in a fraudulent way. The honest way to go about this is to have them register, themselves, for the services that they want and mention you as the one who referred them. This fulfills the requirements of honesty in that these people will be exposed to the services that the company is paying you for promoting. If it turns out that these people cannot do so because they have no Internet access, then this makes it more severely fraudulent for you to use their names, in that they cannot possibly benefit from the services that you are allegedly “referring” them to. And Allah knows best.

In conclusion:
If you are doing ID whereby people register themselves AND they have internet access to do this biz or use it's services - it's HALAL.
It's HARAM IF you are doing ID whereby
1.People sign up WITHOUT seeing the website and it's system, by paying you FIRST and then only registering, OR
2. You register members, they don't register themselves
3. You use fraudulent promotions to gain referrals (not disclosing all details, demanding payment before disclosure)
