Unregulated Forex Becomes Criminal Offence

The explosion of the Forex Market worldwide has created a sort of awkward situation for the Island of Cyprus. Before its acceptance in the EU in 2004, Cyprus was an Offshore Company Tax Haven, because of these tax peculiarities as well as its strategic positioning between three continents, Cyprus experienced a built up of unregulated forex brokers establishing their operations on the island while still being registered in also other offshore tax-heaven jurisdictions such as BVI, Seychelles, Costa Rica, Belize, Mauritius, etc. Since these companies were not and still are not regulated by any well-recognized authority, being just a shell companies, they simply do not comply with any anti-money laundering law, because of this one can only characterize them as cowboy companies.

It is because of these companies amongst others that Cyprus was blacklisted as a money laundering country. But, since 2004 Cyprus has joined the European Union had to comply with European Union law and European Parliament Directives, which it did in large part but not completely. This part compliance has removed Cyprus from the blacklist. The efforts of the Cyprus Republic to regulate its market where serious, in 2003 CySEC was established. CySEC (Cyprus Securities and Exchange Commission ) is a regulatory body – (www.cysec.gov.cy) which amongst others also regulates FOREX. As per its announcement of the 17th June 2009 (full version located at: http://www.cysec.gov.cy/Downloads/E...F/Announcement 06.17.2009 regarding FOREX.pdf) CySEC defines what is considered to be a FOREX company and what are the requirements to operate one, are: “the persons which provide the abovementioned activity of foreign exchange spot trading have the obligation to submit an application to the Commission in order to be granted CIF(Cyprus Investment Firm) authorization.”

Cyprus wants now to safeguard the good name it has fought so hard to establish, it is for this reason that on the 6th of November 2009 a small announcement of only a few lines was dropped as bomb in the forex industry. It simply stated: “The Cyprus Securities and Exchange Commission (‘the Commission’), in continuance with its announcement dated 17 June 2009, wishes to announce the following:

Persons that conduct foreign exchange trading transactions, which do not aim to the physical delivery of the agreed foreign exchange or are not materially settled in cash, should, within one month from the date of the present announcement:

1. submit an application to the Commission for the granting of a Cyprus Investment Firm authorisation, or

2. cease to provide the above service.

The Commission, upon the lapse of the one month notice, intends to take measures against the persons that did not comply with the above as they will be in violation with the provisions of section 4 of the Investment Services and Activities and Regulated Markets Law”. This short statement simply announces to all unregulated companies which are operated from Cyprus – having headquarters in Cyprus, accepting correspondence and money in Cyprus and providing forex services to the internet community, (The short list of these companies is – Prime4X, Forex4You, FXOpen, TadawulFX, IkoFX, eTorro, BroCo and so on) to simply disappear.

This deadline is simply too small for these unregulated companies to go through the process of regulation, it is therefore natural to say that they are not welcome anymore in the Republic of Cyprus and they should either shut down completely or find another country to operate. If they don’t they will be prosecuted at the full letter of the law.

In accordance with Part XVII of the Investment Services and Activities and Regulated Markets Law of 2007 (Law 144(I)/2007) - 140.-(1) A person who is in violation of or does not comply with subsection (1) or (3) of section 4 or section 139, is guilty of a criminal offence, punishable, in the event of conviction, by a term of imprisonment not exceeding five years or by a fine, not exceeding three hundred and fifty thousand euro (€350.000) or both.

This means that nobody will be able to work with these companies, neither Cypriot employee, banks or money transferring organizations; it does not take a genius to understand that if anyone is carrying deposits with these companies will simply not be able to withdraw them and is in very high risk in losing his or her funds forever. This means that these companies become a criminal business.

My best advice therefore is unless a company is regulated, especially if it operates from Cyprus it is not worth to work with. It does not matter how much money in bonus they give you when they will simply not be able to wire it to you, they will disappear one day in Cyberspace like so many others have done before.

Ledakan Pasaran Forex seluruh dunia telah mencipta suatu situasi pelik di Kepulauan Cyprus. Sebelum diterima oleh Kesatuan Eropah (EU) pada tahun 2004,Cyprus adalah sebuah negara Offshore Company Tax Haven (Syurga Cukai Syarikat Offshore), kerana pencukaian pelik ini hanya berada di kedudukan strategic diantara tiga benua, Cyprus pula menghadapi pembinaan broker forex yang tidak berdaftar yang terus beroperasi disebabkan oleh “Offshore tax-heaven” yang diluar bidang kuasa di BVI, Seychelles, Costa Rica, Belize, Mauritius, dan sebagainya. Semenjak syarikat-syarikat tersebut masih lagi tidak berdaftar dan diiktiraf oleh mana-mana pihak berkuasa, mereka hanyalah sebuah syarikat palsu “shell companies”, mereka tidak mematuhi mana-mana undang-undang penipuan wang “anti-money laundering law”, kerana karakter mereka diumpamakan seperti syarikat koboi.

Disebabkan syarikat ini adalah sama dengan syarikat yang telah di senarai hitamkan sebagai penipuan wang negara oleh Cyprus. Oleh itu, sejak tahun 2004, Cyprus telah bergabung dengan “European Union Law” dan
“European Parliament Directives”, telah melakukan tindakkan yang merangkumi jumlah yang besar tetapi masih lagi belum selesai sepenuhnya.Bahagian ini membolehkan Cyprus dibuang dari disenarai hitamkan. Usaha Republik Cyprus untuk melesenkan pasaran adalah serius, semenjak CySEc ditubuhkan pada tahun 2003.CySEC (Cyprus Securities and Exchange Commission) adalah badan pelesenan (www.cysec.gov.cy) diantara semua badan berlesen di FOREX. CySEC mentakrifkan apa yang dianggap sebagai syarikat FOREX dan apa saja keperluan untuk beroperasi satu, adalah: "mereka yang menyediakan kegiatan tersebut di atas aktiviti perdagangan matawang asing mempunyai kewajipan untuk memohon kepada Suruhanjaya supaya diberikan kebenaran CIF ( Pelaburan Cyprus Firm)."

Cyprus sekarang ini ingin menjaga nama baik yang telah diperjuangkan selama ini, oleh kerana sebab inilah pada 6 November 2009 pengumuman kecil telah diumumkan dengan hanya beberapa baris ayat dianggap seperti bom kecil yang telah jatuh di industry forex. Penyataan ringkasnya: “The Cyprus Securities and Exchange Commission ( 'Suruhanjaya'),dengan lanjutan pengumuman tarikh 17 Jun 2009, ingin mengumumkan perkara tersebut:

Mereka yang menguruskan urusan transaksi perdagangan matawang asing, yang mana tidak bertujuan untuk penghantaran fizikal yang telah dipersetujui didalam pertukaran matawang atau yang tidak diselesaikan dalam tunai, mesti, didalam masa sathu bulan dari pengumuman ini diumumkan:

1. memohon kepada Suruhanjaya untuk memberikan kebenaran sebagai sebuah Syarikat Pelaburan di Cyprus yang telah disahkan atau

2. berhenti untuk memberikan perkhidmatan diatas.

Suruhanjaya, setelah selang satu bulan notis, bermaksud untuk mengambil tindakan terhadap orang-orang yang tidak memenuhi ketentuan di atas kerana mereka telah melakukan pelanggaran dengan peruntukan-peruntukan seksyen 4 daripada Perkhidmatan dan Kegiatan Pelaburan dan Pasar Dikawal Undang-Undang". Ini adalah penyataan ringkas yang telah diumumkan untuk semua syarikat yang tidak berlesen yang telah beroperasi di Cyprus- memiliki pejabat di pusat Cyprus, menerima surat maklum balas dan wang di Cyprus dan menyediakan perkhidmatan forex di komuniti internet, (Senarai pendek syarikat tersebut adalah - Prime4X, Forex4You, FXOpen, TadawulFX, IkoFX, eTorro, BroCo dan banyak lagi.) akan sedikit demi sedikit menghilang.

Tarikh tamat yang sekejap ini adalah untuk syarikat-syarikat yang tidak menjalani proses perlesenan, oleh kerana itu adalah wajar untuk mengatakan bahawa mereka sebenarnya sudah tidak diterima lagi di Republik Cyprus dan mereka adalah lebih baik tutup atau mencari negara lain untuk beroperasi. Jika mereka tidak melakukannya tindakkan undang-undang akan dikenakan seperti yang termaktub didalam surat undang-undang.

Sesuai dengan Bahagian XVII daripada Perkhidmatan Pelaburan dan Kegiatan dan Pasar Dikawal Undang-Undang tahun 2007 (UU 144 (I) / 2007) - 140 .- (1) Seseorang yang melanggar atau tidak mematuhi dengan ayat (1) atau (3) daripada bahagian 4 atau seksyen 139, adalah bersalah atas suatu tindakkan penjenayah, dihukum, dalam hal keyakinan, dengan hukuman penjara tidak melebihi lima tahun atau denda, tidak melebihi tiga ratus lima puluh ribu euro (€ 350,000 ) atau kedua-duanya sekali.

Ini bererti bahawa tidak ada seorang pun akan dapat bekerja dengan syarikat-syarikat ini, baik pekerja Cyprus, bank atau organisasi yang memindahkan wang; tidak ada yang bijak pandai yang dapat mengeluarkan wang telah didepositkan dan adalah berisiko tinggi untuk kehilangan dananya buat selama-lamanya. Ini bermakna syarikat ini telah menjadi syarikat jenayah.

Saranan terbaik saya kecuali untuk syarikat yang berlesen, terutama yang beroperasi di Cyprus, adalah tidak berbaloi untuk bekerja atau berurusan dengan mereka. Tidak kisahlah seberapa banyak wang bonus yang mereka berikan, mereka tidak berupaya untuk menghantarnya kepada anda, mereka akan hilang satu hari nanti di dunia siber seperti yang berlaku pada syarikat yang lain.
