These terms and conditions ("Terms") apply to M2U Planner
The M2U Planner service is an information management service that allows you to consolidate and view information relating to your M2U accounts. M2U Planner is not intended to provide legal, tax or financial advice. M2U ia not a financial planners, broker or tax advisor. The Service is intended only to assist you in your financial organization and decision-making and is broad in scope. Your personal financial situation is unique, and any information and advice obtained through the Service may not be appropriate for your situation. Accordingly, before making any final decisions or implementing any financial strategy, you should consider obtaining additional information and advice from your accountant or other financial advisers who are fully aware of your individual circumstances.
The M2U Planner Service (the "Service" or the M2U Planner Service") is provided by Malayan Banking Berhad ("Maybank",“the Bank”"we" and "us") under Maybank2u.com. These Terms of Use describe the terms and conditions for any use of the Service. You shall signify your agreement to the terms and conditions contained herein and accept responsibility for your use of the Service by clicking on the "Continue" button. You should read these Terms of Conditions carefully before you click on the "I agree to the terms & conditions" checkbox and click on the "Continue" button.
Please note that usage of the Service is subject to all applicable laws and regulations and that these Terms of Use are to be read together with the terms and condition of the Maybank2u.com Internet Banking Services and the Maybank2u.com Terms and Conditions of Access. Unauthorised access and use of the Service is strictly forbidden.
Definitions
For the purpose of these Terms of Use, the following terms shall, unless the context otherwise requires, have the meanings as defined below. All other terms not defined herein shall have the meaning as may be defined in the Terms and Conditions of the
(a) Maybank2u.com Internet Banking Services or where no definition has been provided, the said term shall have the meaning as may generally be accepted within the industry based on the context used herein.
(i) "Account" means your savings, current, credit card, loan, investment, fixed deposit, share trading or any other accounts which you may have with the Bank which may be accessed via Maybank2u.com;
(ii) "Bank" means Malayan Banking Berhad and includes its subsidiaries and other companies within the Maybank group, its successors in titles and assigns, and where applicable, any of them;
(iii) "Maybank" refers to the companies within the Maybank group of companies, which are existing now or in the future, owning or owned by under common ownership either directly or indirectly or controlling, controlled by or under common control with Malayan Banking Berhad;
(iv) "Security Access" refers to such confidential authentication information required for your access to and use of Maybank2u.com Internet Banking, whether in the form of words, codes, numbers, sets of characters or such other form or combination thereof, as may be prescribed by Maybank from time to time.
Description of Service
The M2U Planner Service is provided by Maybank via Maybank2u.com and allows customers of the Bank that have subscribed to the Maybank2u.com
Maybank reserves the right to modify, add to, or remove any feature of the Service at its sole discretion from time to time with 14 days prior notice.
Service Charges
Maybank reserve the right to impose a fee for the Service at its discretion at any time upon giving 14 days prior notice to you.
Security and Equipment
(a) Information you provide in connection with the Service will be stored on Maybank2u.com's secure servers and protected by certain encryption techniques. However, the security of the Service depends upon your efforts to protect your Maybank2u Security Access for the Service. You must take all necessary precautions to safeguard your Maybank2u Security Access, which allows you to access the Service.
(b) You shall be responsible for all access and use of the Service via your Maybank2u Security Access whether authorised by you or otherwise and shall indemnify Maybank in relation to any liability, losses or damages suffered or incurred by the Bank arising from the access and use of the Service via your Maybank2u Security Access.
(c) You also have the responsibility to provide any equipment (telephone, computer, etc), software, and services necessary to use the Service.
Maybank2u.com's Proprietary and Intellectual Property Rights
Other than information related to your Account(s) and Bill(s), all content available on the Service (including its arrangement) is the property of Maybank or the relevant Biller or third parties and is protected by copyrights, trademarks, or other intellectual and proprietary rights. Your usage of the Service does not grant you a license or right to use any Maybank2u.com trademark without the express written approval of Maybank. In addition, your usage of the Service does not grant you a license or right to use any third party trademark without the express written approval of the third party possessing rights to such trademark.
Change in Terms of Use and Termination
(a) Maybank has the right to amend these Terms of Use at any time and from time to time with 14 days prior notice to you. Any amendments to these Terms of Use will be effective when they are posted on www.maybank2u.com.my. You are responsible for checking www.maybank2u.com.my periodically for any such amendments.
(b) If at any time you do not agree to the Terms of Use and any amendments made thereto, you may cease use of the Service by deregistering all Bills currently registered and activated under the Service. Your continued use of the Service will be deemed as your acceptance of the Terms of Use and its amendments thereto.
(c) Notwithstanding anything herein, you agree that Maybank shall have the right to suspend, withdraw or terminate at anytime and without notice the Service or any part thereof in relation to all or any of your Accounts or registered Bills, due to your breach of these Terms of Use or for any reason without assigning any reason therefore by giving 14 days prior written notice to you.
(d) These Terms of Use will be effective beginning the date you enroll for the Service until cessation or termination of the Service either by you or by Maybank pursuant to the terms and conditions herein.
Limitation of Liability
(a) Neither Maybank nor any third parties represent or warrant that you will have continuous or uninterrupted access to the Service, or that any of the functions of the Service will be error-free. The Service is provided to you "as is" and "as available", and Maybank and its service providers make no representation or warranty relating functions.
(b) In addition to any other disclaimers and exclusions as may be stipulated in the Maybank2u.com Terms and Conditions of Access and Maybank2u.com Terms and Conditions of Internet Banking Services, and to the extent as may be permitted under law, Maybank disclaims all warranties, conditions, guarantees, representations, express or implied with respect to the Service.
(c) In no event will the Bank or its officers, directors, employees, shareholders, affiliates, agents, licensors, or third party service providers be liable in contract, tort (including negligence) or otherwise for any loss or damage (including but not limited to consequential, incidental, special or punitive damages) sustained by you or any other party arising directly or indirectly from your access or use of the Service including but not limited to loss or damage arising from:
any defect, delays, interruptions or failures in the provision of the Service;
the failure to view due to limitations of the Service or any failure of the Service or any part thereof for any reason;
the corruption, loss of or error in any data or information provided by Maybank for incorporation in your M2U Planner for any reason;
any unauthorised use of the Service and/or intrusion, interference or attack on Maybank2u.com or your Service by any person, virus, Trojan Horse, worm, macro or other harmful components or deleterious programs or files;
your failure, neglect or omission to act in accordance with the terms and conditions of this Terms of Use and any other laws, rules, regulations, policies and guidelines currently in force;
an event which is beyond the reasonable control of Maybank;
Maybank performing and exercising its rights, obligations and discretion pursuant to this Terms of Use; and/or
the act or omission of any party other than Maybank.
Your sole remedy for any failure or non-performance of the Service shall be for us to use commercially reasonable efforts to perform an adjustment or repair of the Service and if you remain dissatisfied with the Service, to discontinue your access and use of the same. The foregoing clauses shall apply to the fullest extent as permitted in law.
Indemnification
Further to any other provisions herein, you hereby agree to indemnify and keep Maybank indemnified from and against any and all claims, losses, liabilities, cost and expenses (including but not limited to any legal fees) arising directly or indirectly or which may arise out of your breach or violation of these Terms of Use or any third party rights or your use or purported use of the Service.
Evidence and Use of M2U Planner
(a) You acknowledge and agree that in the absence of a manifest error, all evidence of communications transmitted between you and Maybank, including the M2U Planner and any evidence in the form of, among others, computer printouts, transaction logs, and any other form of information and data storage, shall be binding on you and treated as conclusive evidence of your instructions, transactions and the communications between you and Maybank, for all purposes.
Queries and Complaints
(a) In the event that you have any queries, complaints and/or disputes arising from your access to and use of the Service, you shall refer the matter to Maybank as per the relevant contact details as stipulated in the Maybank2u.com website.
(b) Maybank shall use its reasonable endeavours to respond to the queries and resolve any problems or issues as may be raised by you.
(c) You shall specify the nature of your query, complaint and/or dispute and such other details or information as may be required by Maybank and such complaint and/ or dispute shall be handled and/or resolved in accordance with Maybank's internal complaints and dispute resolution procedure.
Changes to procedures and processes or branding
You acknowledge that to (inter alia) ensure the smooth and efficient provision of the Services and/or to improve the Services, Maybank shall have the right and discretion to make such amendments and modifications as it deems necessary to (i) the procedures and processes applicable to the Services (i.e. procedure for acceptance of Terms of Use, registration and activation of M2U Planner, etc); and (ii) the trade or service names used in relation to the Services (i.e. M2U Planner, etc) as referred to in these Terms of Use., by giving 14 days written notice to you. Notwithstanding the same, you hereby agree that pending actual changes being effected to these Terms of Use, the said Terms of Use shall nevertheless continue to be applicable to the Services whereby the amended or modified procedures and processes and/or new trade or services names shall be deemed to replace the previous procedures and processes and/or new trade or services names, accordingly.
Severability
In the event any portion of these Terms of Use is found to be unlawful or illegal or unenforceable, such portion shall be excluded from these Terms of Use, and such exclusion shall not affect the enforceability, legality and lawfulness of these Terms of Use in any way and the remaining terms shall be separately enforced to the maximum extent permissible so as to effect the intent stated in these Terms of Use.
Waiver
In the event that Maybank fails to or neglects to enforce any terms, provisions or remedies under these Terms of Use or otherwise in relation to the Service for whatever reason, Maybank shall neither be construed as having waived its rights to any preceding, continuing or subsequent breach of the same or any other provisions stated in these Terms of Use.
Laws and Jurisdiction
(a) The Service provided herein is governed by the laws of Malaysia and you hereby consent and submit to the exclusive jurisdiction and venue of the courts in Malaysia in all disputes arising out of or relating to the use of the Service.
(b) Use of the Service is unauthorised in any jurisdiction that does not give effect to all provisions of these Terms of Use and/or the Maybank2u.com Terms and Conditions of Access.
When you use M2U Planner, you:
Authorize M2U Planner to use information provided by you to; retrieve information requested by you (including information concerning individuals and other entities you have set up to receive payments from you ("Payees") and payments you have made to Payees); to copy or transfer such Payee and payment information; to register to view the accounts requested by you and to otherwise use, modify, display, distribute and create derivative works from such information to provide M2U Planner to you. For these purposes you appoint M2U and its service provider as your agent with the full power to do and perform each act or thing requisite and necessary to be done and as fully as you might or could do in person;
represent that you are the legal owner of the account and that you have the authority to designate M2U and its service provider as your agent and to give us the information you provide to use M2U Planner;
acknowledge that when M2U and its service provider accesses and retrieves information , they do so as your agent
acknowledge that balances shown on M2U Planner may not be as accurate as if the M2U website or Third Party Website were accessed directly.
represent that all information you provide to M2U and its service provider in connection with M2U Planner is accurate, current and complete, and that you have the right to provide such information to M2U and its service provider for the purpose of operating M2U Planner. You agree to not misrepresent your identity or your account information. You agree to keep your registration and account information up to date and accurate.
are responsible for maintaining the confidentiality of your personal identification number ("PIN") and other log-in information in relation to M2U Planner
You must not
disclose your PIN and other log-in information to any other person, except to the extent necessary for M2U to provide M2U Planner to you;
keep a record of your PIN and other log-in information;
write your PIN down and other log-in information;
negligently or recklessly disclose your PIN and other log-in information by, for example, failing to take reasonable care when typing it or keying it in
The PIN and other log-in information that you select must not be easily identifiable or based on easily accessible personal data.
You are permitted to use content delivered to you through M2U Planner only on M2U Planner. You may not copy, reproduce, distribute, or create derivative works from this content or reverse-engineer any part of M2U Planner.
Except to the extent prohibited by law, regulation or code of practice or conduct (including the Electronic Funds Transfer Code of Conduct or the Code of Banking Practice), you agree to protect and fully compensate M2U and its service provider from any and all third party claims, liability, damages, expenses and costs (including, but not limited to, indirect, incidental, consequential loss and damage) caused by or arising from your use or the inability to use M2U Planner; your violation of these Terms; unauthorised access to or alteration of your transmissions or data; your infringement, or infringement by any other user of your account, of any intellectual property or other right of anyone and the use, inability to use, unauthorised use, performance or non-performance of any Third Party Website.
M2U cannot always anticipate technical or other difficulties. These difficulties may result in loss of data, personalised settings or other interruptions to M2U Planner. Except to the extent prohibited by law, regulation or code of practice by Bank Negara of Malaysia, M2U is not liable for the timeliness, accuracy, deletion, failure to deliver or failure to store any data, communications or personalised settings. To the maximum extent permitted by applicable law, M2U disclaims all liabilities and warranties of any kind relating to M2U Planner, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose or non-infringement.
Any information and material downloaded or otherwise obtained through the use of M2U Planner is done at your own discretion and risk.
M2U reserves the right to cancel, suspend and/or modify your access to M2U Planner services through M2U Planner at any time and with 14 days prior notice. You agree that M2U will not be liable to you or any third party for any cancellation, suspension or modification of M2U Planner
M2U Planner allows you to share your accounts with other users (each a "designated recipient"). It is your responsibility to choose with whom you will share your accounts and to set your permissions for each designated recipient carefully. Depending on the permissions you set, a designated recipient will be able to see your account information, including individual transactions, and be able to control your accounts to the same extent as you can control them through M2U Planner.
You share your accounts with designated recipients at your own discretion and risk.
You indemnify and hold M2U and the service provider harmless from any loss, cost, liability, harm or consequence of any kind that is suffered or incurred by M2U or the service provider as a result of you sharing your account information in any manner with a designated recipient.
It is your responsibility to enter all of your information accurately. You will be prompted to create, enter, and share confidential information to establish a relationship between your account and a designated recipient. The confidential information is to ensure that only the intended designated recipient can complete the sharing process to have access to your accounts. As the 'owner' of the account, you can establish, modify, or remove the level of access to your account by designated recipients at any time.
If you are a designated recipient, you will be required to enter the confidential information during the final step of the sharing process and must take the same cautions with the shared account as you do your own accounts.
If you are a designated recipient you indemnify and hold M2U and the service provider harmless from any loss, cost, liability, harm or consequence of any kind that is suffered or incurred by M2U or the service provider as a result of sharing an account owner's account information.
M2U will not collect sensitive information about you, such as health information, without your consent.
