Kengakawan... nak tanya sket pasal klausa dlm S&P kat bawah ni...

3.1.1 = 3% earnest deposit

3. PAYMENT OF PURCHASE PRICE

3.1 The Purchase Price shall be paid by the Purchaser in the following manner:-

3.1.1 the Earnest Deposit has been paid to the Vendor prior to the execution of this Agreement, the receipt whereof the Vendor hereby acknowledges;

3.1.2 the Balance Deposit shall be paid to the Vendor within one (1) month from the date of this Agreement less RM450-00 being apportionment of valuation report in order for the Purchaser to withdraw from Employees Provident Fund. The balance of the Deposit Sum together with the Earnest Deposit shall hereinafter be referred to collectively as “the Deposit Sum” and in the event of the completion of the Sale and Purchase herein the Deposit Sum shall form part of the Purchase Price of the said Property.
 
nak tanya apa tt, maknanya dah jelas tu
clause tu kena baca bersama clause2 lain, ringkasnya 3% deposit buyer dah bayar dan bakinya (7%) perlu dibayar kpd pemilik/penjual dlm masa sebulan dari date snp.....dan deposit adalah sebahagian dpd rege property?

kalau tak silap;

kan kalau buyer tu setuju je nak beli..dia bayar 3% deposit...
supposed 7% of total 10% deposit perlu dijelaskan semasa sign S&P...

tapi, klaus ini cakap, kalau buyer nak guna KWSP untuk bayar balance 7% dari deposit guna KWSP, buyer ni kena bayar rm450 kepada penjual...

ni berdasarkan pemahaman la...tak tau ape pandangan yang lain2...

bayaran valuation report terpulang kepada persetujuan antara penjual pembeli, biasanya pembeli yg kena bayar

kalau ikut pemahaman den, macam terbalik. penjual yang kena tanggung valuation report. pembeli yang lantik valuer. fee valuer, tolak dgn 7% balance yang belum dibayar, max. RM450.

A'ah mcm tu laa pemahaman aku, tapi aku dah call lawyer mintak remove clause byr guna EPF & valuation report tu.
 
Satu lagi clause yg ni:

"The Vendor warrants that the Property shall be substantially in the same state and condition at the time of delivery of vacant possession as at the time of inspection by the Purchaser together with the Vendor, fair wear and tear excepted. In the event that substantial damage or loss is caused to the Property before the delivery of vacant possession of the Property, the Vendor shall forthwith make good the damage or loss to the Property at the Vendor's own costs and expense."

Seblum sign Agree to Purchase form buyer suruh segala kerosakkan /defect masa inspection aku kena tanggung. Aku jawap rumah tu jual atas dasar AS-IT-IS condition , segala repair dia kena buat sendiri. So utk selamat aku nak list down dalam Appendix seme defect yg dilihat semasa inspection rumah dgn buyer. Ini nak mengelak nanti dia kata kerosakkan tu takde masa inspection & aku kena bayar kos repair.
 
kat klaus tu cakap shall be paid to vendor(penjual)...

kalau kes macam ni..baik cakap bebaik ngan lawyer..bagi kedua2 pihak paham jelas sejelas2nya...
