Mahkamah keluar waran tangkap Jho Low, bapa


PUTRAJAYA: Mahkamah Sesyen di sini, hari ini mengeluarkan waran tangkap terhadap ahli perniagaan Low Taek Jho atau Jho Low dan bapanya, Tan Sri (Larry) Low Hock Peng.

Mereka berdua dikehendaki pihak berkuasa bagi membantu siasatan berhubung tuduhan pengubahan wang haram berkaitan skandal 1Malaysia Development Berhad (1MDB)

Sumber memberitahu NSTP, waran tangkap itu dikeluarkan selepas mahkamah membenarkan permohonan polis dan Pejabat Peguam Negara untuk mengeluarkan waran tangkap terhadap dua individu berkenaan, yang dipercayai sudah melarikan diri ke luar negara.

Menurut sumber, waran tangkap itu untuk membolehkan polis Malaysia mendapatkan kerjasama polis antarabangsa (INTERPOL) untuk mengeluarkan notis merah bagi menjejaki kedua-dua individu berkenaan.

Permohonan yang difailkan di Mahkamah Sesyen di sini pagi tadi juga bagi membolehkan kerajaan memohon perintah ekstradisi terhadap Jho Low dan bapanya yang dipercayai bersembunyi di China atau Abu Dhabi.

Sementara itu, menurut laporan The Edge, Jho Low dipercayai dikenakan lapan tuduhan mengikut Seksyen 4 (1) (a) Akta Pencegahan Pengubahan Wang Haram dan Pencegahan Pembiayaan Keganasan, 2001 (Akta 613) kerana memindahkan wang tunai.

Menurut laporan itu, Hock Peng turut berdepan satu tuduhan memindahkan AS$56 juta (RM230 juta) kepada anaknya.

Keseluruhan jumlah dalam urus niaga terbabit dianggarkan sebanyak AS$261 juta (lebih RM1 bilion) untuk penerimaan wang dan AS$196 juta (kira-kira RM805 juta) untuk pemindahan wang tunai yang dilakukan melalui akaun berasingan di Bank BSI Singapura antara Disember 2013 dan Jun 2014.

Sebahagian besar wang itu digunakan untuk membeli kapal persiaran mewah Equanimity bernilai AS$250 juta (RM1 bilion).

Media sebelum ini melaporkan, Peguam Negara Amerika Syarikat (AS), Jeff Sessions menggambarkan skandal 1MDB sebagai 'kleptokrasi paling buruk’.

Jabatan Kehakiman Amerika Syarikat (DoJ) turut menggelar 1MDB sebagai kleptokrasi terbesar di dunia dan badan perundangan negara lain seperti Switzerland dan Singapura sudah mengambil tindakan terhadap bank serta individu berhubung dakwaan wang haram yang dikaitkan dengan 1MDB.

KUALA LUMPUR: The Putrajaya Sessions Court today issued a warrant of arrest against controversial billionaire Low Taek Jho, or Jho Low, and his father, Low Hock Peng, to assist the probe into the 1Malaysia Development Berhad (1MDB) scandal.

The warrant was issued after the court allowed an application by the police and the Attorney-General’s Chambers to seek the order so as to enable the two to be repatriated to face money laundering charges against them.

Inspector-General of Police Mohamad Fuzi Harun, confirming the matter in a statement, said the warrants would enable the police to seek cooperation from Interpol to issue a red notice to detect and arrest the duo.

He said the warrants of arrest were obtained after the charges against Jho Low and his father were filed at the Putrajaya Sessions Court in accordance with Section 4 (1) of the Anti-Money Laundering and Anti-Terrorism Financing Act (AMLATFA) 2001.

“The Commercial Crime Investigation Department has conducted an investigation into 1MDB for various criminal offences involving the financial transactions and businesses conducted by the company.

“The investigation papers were referred to the Attorney-General’s Chambers and a decision was made to charge the two individuals in court today,” he said.

According to media reports, the two are currently believed to be either in China or Abu Dhabi.

PETALING JAYA: Pressure will mount on elusive businessman Low Taek Jho, better known as Jho Low, and his father as their movements will be restricted following the request by Malaysian police to Interpol to issue a red notice to arrest them, lawyers said.



They said both should be handed over to Malaysian police if law enforcement agencies outside Malaysia were prepared to hunt them if they are hiding in an Interpol-member country.

However, they said any attempt to bring them to face trial could be frustrated if the foreign nation concerned refused to co-operate.

Lawyer SN Nair said the warrant of arrest obtained by police against Jho Low and his father, Low Hock Peng, yesterday had facilitated Interpol to issue the notice.

“Interpol member countries should look for the father and son as there is a warrant of arrest issued against them now,” he said.

Nair said the warrant of arrest obtained against Jho Low and his father was a significant development that the long arm of the law was catching up with the two.

The lawyer said this in response to police registering criminal charges against Jho Low and his father with embezzling funds allegedly stolen from state investor 1Malaysia Development Bhd (1MDB).

Jho Low is scheduled to face eight charges under the Anti-Money Laundering and Anti-Terrorism Financing Act 2001.

Three charges were for receiving money and the remaining five were for transferring the cash.

The father faces one charge of transferring US$56 million to his son.

The charges were filed against the two in their absence at the Sessions Court registry in Putrajaya yesterday.

Following this, police have also obtained warrants of arrest against the two from the court.

Lawyer N Sivananthan said the two men could now be extradited if caught in a foreign jurisdiction.

“Their movements will be restricted as police in other jurisdictions will be put on alert and will arrest the two if they are hiding in their country,” he said.

He said Jho Low and his father would also be careful when travelling to another country as they could be arrested upon landing due to the red notice.

However, Sivananthan said their arrest could be an uphill task if the Interpol member country refused to execute the warrant of arrest.

“If that is the case, the father and son could continue to live there for as long as they wish,” he added.

According to media reports, the two were currently believed to be in either China or Abu Dhabi.

Council of Eminent Persons chairman Daim Zainuddin said the government was aware of the whereabouts of Jho Low.

“We know his whereabouts. The last time he was in Macau.

“I think the government knows where he is,” he said earlier this week at a press conference to announce that the CEP had completed its 100-day mandate.

SELENGGARA EQUANIMITY: KERAJAAN BELANJA RM2 JUTA SETELAH 20 HARI

Kapal mewah Equanimity telah tiba di perairan negara pada 7 Ogos 2018. Kerajaan membuat pengumuman akan menanggung kos penyelenggaraan dan kerosakan ke atas kapak mewah tersebut.

Kerajaan juga perlu berbelanja RM3 juta sebulan bagi kerja-kerja penyelenggaraan kapal mewah itu.

Sebuah Syarikat penyelenggaraan telah dilantik kerajaan untuk menyelenggara dan memastikan keselamatan kapal dan semua 18 kru sepanjang tempoh penyitaan mahkamah.

Menurut sumber sehingga hari ini iaitu pada 27 Ogos 2018, kerajaan telah membelanjakan RM2 Juta dari duit rakyat untuk menyelenggara kapal tersebut. Jumlah itu akan dibayar kepada syarikat penyelenggaraan itu.

Setakat hari ini pihak kerajaan masih lagi belum mendedahkan syarikat manakah yang dilantik untuk menyelenggara Equanimity.

Sebelum ini, kos selenggara sebanyak RM3 juta telah menjadi tandatanya kepada orang ramai termasuk pakar-pakar pelayaran.

Seorang pakar kapal mewah iaitu Pengarah operasi Mega Yacht Club of Vanuatu Ltd, Nicholas de Souza, berkata jumlah RM3 Juta itu adalah lebih daripada mencukupi untuk pengambilan 25 anak kapal dengan gaji yang tinggi dan kapten kapal kanan secara tetap.

"RM3 juta sudah tentunya cukup memberi krew-krew kapal menginap di hotel 6 bintang dan cukup untuk berpesta setiap hari atau mengadakan pesta yang amat besar setiap minggu di atas kapal tersebut," katanya.

Beliau menyatakan demikian ketika diminta mengulas satu laporan berita bahawa ia menelan kos kira-kira RM3 juta sebulan untuk menyelenggara sebuah kapal layar yang amat besar.

Equanimity, telah dikaitkan dengan kontroversi dan didakwa oleh Kerajaan yang ia dibeli dengan menggunakan dana yang dicuri daripada 1MDB. Bekas Perdana Menteri iaitu Ds Najib Razak juga turut dituduh terlibat dalam skandal ini.

Kapal sepanjang 91.5 meter itu tiba di Pelabuhan Klang pada 7 Ogos 2018 selepas kerajaan Indonesia, yang merampasnya awal tahun ini, bersetuju untuk menyerahkan penjagaannya kepada pihak berkuasa Malaysia setelah mereka berasakan tidak perlu untuk menanggung kos selenggara Kapal mewah tersebut.

Kapal mewah tersebut telah disita dan diarahkan untuk parkir di pelabuhan mewah yang juga tempat berlabuh untuk kapal Star Cruise iaitu di Bousted Cruise Center, Port Klang.

Menurut de Souza lagi, walaupun kos boleh berbeza-beza dari satu tempat ke tempat lain, perbelanjaan penyelenggaraan asas untuk kapal layar mewah di Langkawai hanya mencecah kira-kira RM75,000 sebulan melibatkan krew minimum dan bayaran tempat parkir.

Jho Low dilapor belikan Ferrari untuk KimK

PETALING JAYA: Ahli perniagaan Low Taek Jho didakwa membeli Ferrari putih untuk bintang realiti TV, Kim Kardashian pada 2011.


Menurut laman portal Page Six, Kim dan bekas suaminya, Kris Humphries, telah diberikan kereta itu sebagai hadiah perkahwinan pada tahun 2011.

Pasangan itu dilaporkan berebut kereta yang dibeli dengan harga AS325,000 (RM1.35 juta), ketika bercerai beberapa bulan kemudian.

Menurut Page Six lagi, bulan lalu Kardashian dilihat tiba makan malam di Miami menaiki Ferrari bewarna putih, tetapi pegawai seranta yang juga pegumannya tidak mendedahkan sama ada dia masih memandu kereta tersebut.

Laporan itu juga mendedahkan tetamu majlis perkahwinan yang hadir ketika itu hanya dikenali sebagai ahli pernigaan Malaysia.

Sumber kepada portal atas talian itu menambah penderma adalah Low.

Dilaporkan bahawa polis telah memfailkan tuduhan jenayah terhadap Low, yang dikenali sebagai Jho Low, dan bapanya Tan Sri Low Hock Peng yang didakwa mencuri daripada 1MDB.

Tuduhan penggubahan wang haram itu dibuat terhadap Low dan bapanya secara 'in absentia' (tanpa kehadiran pihak tertuduh atau wakil/ peguamnya) oleh ia dilakukan oleh polis di Jabatan Siasatan Jenayah (JSJ) dan Jabatan Peguam Negara.

Perdana Menteri Tun Dr Mahathir Mohamad mendedahkan ahli perniagaan Low Taek Jho atau Jho Low sedang bersembunyi di satu tempat dan kerajaan tidak dapat menjejakinya.

Ditanya dimana Jho Low bersembunyi sama ada di China atau Malaysia, Mahathir enggan menuduh sesiapa.

Mahathir juga secara berseloroh meminta wartawan sama ada tahu sesiapa yang mahu membeli kapal layar mewah Equanimity dan menawarkan komisen kepadanya jika berjaya mendapatkan pembeli.

Mahkamah Tinggi Kuala Lumpur pada akhir Ogos lalu membenarkan permohonan untuk menjual kapal layar mewah Equanimity sementara perbicaraan diteruskan.

Equanimity dikaitkan dengan Jho Low yang didakwa adalah pemiliknya.
