Melaka: "Saya mahu hukuman gantung sampai mati. Itu sahaja," kata tertuduh, Ng Chan Keong, 39, ketika diberi peluang oleh Mahkamah Tinggi Ayer Keroh, hari ini, untuk menyatakan hasrat terakhir selepas disabitkan atas pertuduhan mengedar dadah methamphetamine seberat 2.7 kilogram (kg), enam tahun lalu.

Hakim Datuk Anselm Charles Fernandis bagaimanapun menegaskan hak mahkamah untuk menentukan hukuman dan menangguhkan prosiding selama lima minit.

Sebaik prosiding bersambung beliau menjatuhkan hukuman penjara seumur hidup bermula dari tarikh tertuduh ditangkap pada 2 Oktober 2018 dan 12 sebatan.

Terdahulu, ketika membacakan penghakimannya, Anslem berkata, selepas menimbangkan keseluruhan keterangan dan hujah kedua-dua pihak pembelaan dan pendakwaan, mahkamah mendapati tertuduh gagal menimbulkan keraguan munasabah terhadap kes itu.

Beliau berkata, bagaimanapun mahkamah berpuas hati pendakwaan membuktikan kes terhadap tertuduh melampaui keraguan munasabah.

Mengikut pertuduhan, Ng didakwa mengedar dadah berbahaya jenis methamphetamine seberat 2.7 kilogram di tepi lorong kecemasan KM 215 arah Kuala Lumpur-Johor Bahru, Lebuh Raya Utara Selatan, dekat Alor Gajah di sini, pada 2 Oktober 2018, kira-kira jam 5 petang.

Dia didakwa mengikut Seksyen 39B(1)(a) Akta Dadah Berbahaya 1952 dan boleh dihukum mengikut Seksyen 39B(2) akta sama, sabit kesalahan boleh dihukum gantung sampai mati.

Pendakwaan dijalankan Timbalan Pendakwa Raya Mohd Asri Abdul Rahman Sidik dan Nabilalif Mohd Rosli manakala tertuduh diwakili peguam Wan Zaleha Abdul Wahab.

Seramai 13 saksi pendakwaan dan dua saksi pembelaan memberi keterangan sepanjang perbicaraan kes itu bermula 10 September 2020.

Sementara itu, seorang wanita ahli keluarga tertuduh bertindak biadap dengan menghalang wartawan merakam gambar tertuduh selepas prosiding selesai.

Malah, tertuduh turut memaki hamun wartawan, sebelum ditenteramkan oleh polis mahkamah.

When delivering the verdict, Anselm stated that the defendant failed to raise reasonable doubt after the court considered all the evidence and arguments presented by the defence and prosecution.

The defence team argued that Ng was not aware of the presence of drugs in the trunk of the car that he was driving on the day he was stopped by the police while travelling from Genting Highlands to Johor Bahru.

"The defendant [Ng] stated that he went to Genting Highlands with his boss, known as Tan, who was also the second defence witness a day earlier, and stayed at a hotel there.

"The defendant claimed that Tan requested him to drive the car to Johor Bahru and hand over RM180,000 and SGD9,300 (about RM32,600) in cash to Tan's female friend.

"The defendant stated that he only drove the car and did not inspect it before being stopped by patrol police while on the road," Anslem said.

However, the High Court judge stated that Ng's attempt to speed away, refusal to open the trunk, and attempted bribery of the police indicated that he was aware of the presence of drugs in the car.

The court also found Tan to be an unreliable witness, reported Berita Harian.

Ng was convicted and sentenced yesterday after 15 witnesses were called to the trial, which began on 10 September 2020.
