General overview.

Recently, we`ve been contacted by hundreds of entrepreneurs from the EU, Asia and North America, who want to import urea from Ukraine. They say that saw lots of advertisements all over the internet to export urea from Ukraine in unlimited quantities. Because we have very good relations with all major Ukrainian urea producing plants and know this market, we decided to debunk some myths and reveal the truth on Ukrainian urea market as well as to teach buyers how to avoid most common mistakes.
As it is well known, Ukraine is one of the leading producers and exporters of nitrogen fertilizers in the world. Currently, chemical industry products amount up to 10% of Ukrainian exports (around 90% - nitrogen fertilizers). Ukrainian share of global mineral fertilizer market is about 10%. Ukraine sells fertilizers to about 70 countries all over the globe (main export destinations are Brazil, Turkey, Mexico, Vietnam and India). Urea amounts to 70% and ammonia nitrate - 20% of Ukrainian nitrogen fertilizer exports.
1 Myth: We can easily buy millions of tons of urea from Ukraine.
Truth: There are 8 big mineral fertilizer producers in Ukraine. 6 of them specialize in production of nitrogen fertilizers and form a foundation of Ukrainian chemical export: plants from Horlivka and Odesa possess around 24% of production; Cherkasy, Dniprodzerzinsk - about 22% and Severodonetsk - up to 10%. Annually they produce only 3,6 million tons of urea. Some part of this urea is sold internally, i.e. on Ukrainian domestic market. Currently, Ukraine exports about 280.000 tons of urea and 130.000 tons of ammonia nitrate per month. The average Ukrainian urea plant exports only around 300.000 tons of urea per year. These figures are very stable and annually fluctuate very slightly. When we see an URGENT!!! order for 2-3 million tons of urea, it is clear that this people sell the air, they’ve never seen the product and never worked in the filed. So, if you see an advertisement that someone can export a few millions tons of urea from Ukraine – for sure this is a fraud. Stay away from these people.
2 Myth: Ukrainian urea is very cheap.
Truth: All you need to produce cheap fertilizers is cheap gas, which is used in production. Till 2004 Ukrainian plants paid almost the same price for Russian gas as Russian producers – around 35-55 USD for 1.000 cubic meters, which is extremely cheap. In 2004 Russia unilaterally terminated contract on gas supply with Ukraine and raised the gas prices 2-3 times. This dramatically increased the urea production costs and consequently the end product price. In addition, every month the Ministry of Economy sets up the indicative price for exports of urea and ammonia. Producers are obliged to sell the products not cheaper than the indicative price. There`s no indicative price for export of ammonia nitrate, but the international supply contract is to be registered with the Ministry of Economy. For example, the indicative price for exports of urea in July is 280 USD per ton, the price for ammonia – 225 USD per ton. So, if anyone claims to sell you Ukrainian urea or ammonia cheaper than the indicative price – for sure this is a fraud. Stay away from these people.
3 Myth: We will pay by letter of credit and require performance bond.
Truth: Forget it! All urea producers require 100% advance payment and no one accepts performance bond. A plus is that you can visit the plant, meet the people in person and sign the contract.
4 Myth: We will buy urea under CIF terms.

Conclusion.
Ukraine is a net exporter of mineral fertilizers, especially nitrogen fertilizers. Because demand greatly exceeds offer, it will be very hard to get a contract for a foreign company without professional aid of Ukrainian agent. Typical payment methods as well as terms of delivery are not applicable. Promise to export millions of tons of Ukrainian urea at price below 200 USD is a myth, which will cost you lots of money and time.

Urea General Overview

Buying Ukrainian mineral & nitrogen fertilizers (ammonia, ammonia nitrate, urea) – latest trends
The only success factor of Ukrainian chemical and fertilizer producers are high world prices for ammonia, ammonia nitrate and urea.

Last year became real tryout for Ukrainian chemical and fertilizer manufacturers and for chemical industry as a whole. Tremendous price hike for the main technological raw material and energy source (Russian natural gas), forced all Ukrainian chemical and fertilizer manufacturers to modernize and update production using latest energy-saving technologies.

Russian price surge was a real blow mainly for nitrogen fertilizer manufacturers (ammonia, ammonia nitrate, urea), because natural gas accounts to almost 80% of production expenses and it is impossible to substitute it with any other raw material. Volume of gas consumption in the production process is to be at the level of 1.000 cubic meters per 1 ton of ammonia, but de facto it is much higher and equals to almost 1.250 cubic meters per ton. All these factors led to 2% decrease in annual production of Ukrainian ammonia and urea.

Gas price increase also affected badly varnish-and-paint production sector, which declined up to 15%. Other reasons for varnish-and-paint production decrease were domestic market glut and inflow of cheap imports.

Small increase in production (+ 1,7%) showed producers of conventional chemical products, like sulphuric acid, sodium carbonate, etc. Last year the greatest success among all chemical manufacturers achieved producers of plastics, who increased production 15,8%, comparing to previous year figures.

Due to above-mentioned reasons the last year`s production growth of Ukrainian enterprises in chemical industry rose only 0,9% comparing to 2006 and accounted to approximately $5 billion. The average annual growth of this industry in previous years was at the level of 7-8%.

We can draw a conclusion that prospects of Ukrainian chemical, mainly fertilizer, industry will depend strongly on future prices for natural gas, world market trends as well as modernization of production. Only high world price for ammonia, which rose in 2007 up to $380 per ton, helped Ukrainian nitrogen fertilizer manufacturers to survive gas price surge and start-up far-reaching modernization processes. Should modernization measures are successfully accomplished, Ukrainian producers can increase production and become even more competitive.

Why 100% advance payment is safe in Ukraine?

General overview.

Recently, we`ve been contacted by hundreds of entrepreneurs from the EU, Asia and North America, who want to buy different commodities from Ukraine. 95% of these buyers indicate in their inquiries that they accept only LC or BG.

Because of these payment methods almost all inquiries are not even considered by Ukrainian producers and exporters.

That is why we decided to explain to foreigners why 95% of Ukrainian exporters only accept 100% advance payment and why it is safe.

Description.

Monetary control in foreign trade exists only in post-Soviet countries, like Ukraine, Russia, Belarus and other countries of former USSR. According to the Law of Ukraine “On procedure of payment in foreign currency” the exporter is obliged to deliver the goods within 180 days of receiving advance payment from the foreign buyer. The law provides longer terms of delivery in such fields as aerospace, pharmacy, shipbuilding.
If the exporter doesn`t deliver the prepaid goods within 180 days, which is proved by customs declaration or it delivers inferior goods or doesn`t deliver all quantity of prepaid goods, indicated in supply contract, the exporter will be fined by the local tax office. Exporter will be obliged to pay 0,3% of the outstanding amount of undelivered goods FOR EVERY DAY OF UNDELIVERY! If you calculate the amount of penalty – it is really huge. In addition, there is no any limit for this penalty.
The only reason to stop calculation of it is weather to ship to the buyer amount of outstanding/inferior goods or to return the sum of prepayment for the quantity of outstanding/inferior goods. A situation when you make advance payment and exporter refuses to deliver the goods to you is simply not possible in Ukraine, because in 180 days the exporter will have to pay a huge penalty.
It means that exporter is the most interested party to meet all its contractual obligations in a good faith; otherwise not only the foreign buyer may use contractual penalty against him, but also tax office may fine such exporter.

Conclusion.

Remember that when you deal with Ukrainian exporters and producers, the foreign buyer is protected twice: first, by the contract and second – by the law. It means that Ukrainian exporters who accept advance payment can become your hostage and you can force them to meet their contractual obligations, otherwise they may be fined by you and the government.

But be wary, this method of payment is safe only if your Ukrainian counterpart is a genuine and legitimate company. If it is a fraudster, even the guarantee from almighty god will not be safe!
